Key Changes to Irish Defamation Law

3 min read

The Defamation (Amendment) Act 2026 represents the most significant reform of Irish defamation law since 2009. The Act's key provisions came into force on the 1st of March 2026.

The reforms aim to modernise Ireland's defamation framework by balancing the right to freedom of expression with the protection of personal and corporate reputations, while reducing legal costs and improving access to justice.

Key Changes Introduced by the Act:

  • New Protections for Retailers

A new statutory defence has been introduced for retailers. A Defence may arise where staff ask customers whether goods or services have been paid for, request proof of purchase or raise issues relating to payment methods.

However, the defence is not automatic. Retailers must ensure such enquiries are made discreetly, are not excessively communicated to others and are made by a person with a legitimate duty or interest in doing so.

  • High Court Defamation Cases to Be Heard Without Juries

One of the most significant changes is the abolition of juries in High Court defamation proceedings. All defamation actions issued after the 1st of March 2026 will be determined by a Judge sitting alone. The reform is intended to reduce delays and costs, improve consistency in decisions and align Ireland with other common law jurisdictions.

  • New "Serious Harm" Test for Companies

The Act introduces a higher threshold for corporate defamation claims. Companies must now demonstrate that a defamatory statement has caused, or is likely to cause, serious harm. For businesses operating for profit, this means proving serious financial loss. The change is designed to discourage claims based on minor or speculative reputational damage.

  • Easier Public Interest Defence

The defence of fair publication in the public interest has been simplified. A defendant must show that:

  1. The publication related to a matter of public interest;

  2. They reasonably believed publication was in the public interest; and

  3. The publication was made in good faith.

These changes provide greater clarity and protection for journalists, publishers and others reporting on matters of public importance.

  • Defence for Live Broadcasters

The Act also introduces a defence for live broadcasters where defamatory statements are made by third parties during live programmes. To rely on this defence, broadcasters must demonstrate that they took reasonable and prudent precautions to prevent the publication of defamatory material, such as staff training, risk assessments and appropriate moderation procedures.

  • Identifying Anonymous Online Publishers

The Circuit Court now has jurisdiction to order social media platforms and other intermediary service providers to disclose information identifying anonymous users who have allegedly published defamatory content online. The applicant must satisfy the court that the information is necessary and that the interests of justice require disclosure.

  • Encouraging Early Resolution of Disputes

The Act promotes alternative dispute resolution through an enhanced "offer of amends" procedure. Publishers can seek to resolve disputes by issuing corrections, apologies or other remedies without the need for lengthy court proceedings. Courts may take such steps into account when deciding legal costs.

Effect on Businesses and Individuals:

The reforms affect both those bringing defamation claims and those publishing content. Individuals and businesses should carefully assess whether the new legal thresholds can be met before pursuing proceedings. Organisations, retailers, publishers and broadcasters should review their communication practices, staff training and internal policies to ensure compliance with the updated legal framework.
